The court overturned judge Angel’s decision for new trial saying he got the facts wrong – how did they prove this? by getting the facts wrong!

As we head to the Supreme Court we have to, at first, deal with a smaller window to go through  —  the major trial errors you have been reading about in this blog, like perjury and the many Brady violations, were not brought up or discovered in the previous motions or hearing at question now.

Thank heavens though the higher court continues to get it’s facts wrong. Just like when you read here before — when they simply invented that witness Angie White had seen a car with a “particular dent.”

But here we have this.

From the court’s opinion:

“Chief Deputy Cleek testified at trial that the first time he went to talk with her, Ms. Hill was in no position to either give a statement or look at pictures because she was unconscious.”

Where do they get this stuff from? They just make it up is what they do.

No. Becky Hill was not unconscious when Cleek took her the photos. Nice try.

Nor was she in bed like Cleek testified to. Beck Hill was with her sister Rachel and went in the kitchen to look at pictures with deputy Cleek and did not make an identification. In private. Then she went to the Sheriff’s office a few days later to make her identification. What happened in those few days is what I want to know.

But really, by reading the transcript below, you see both Cleek and Hill trying to adhere to the new lie in the trial. That despite Hill’s testimony at the preliminary hearing, when her memory is fresher, they want you to think she made her “spontaneous” identification at the Sheriff’s office.

Deputy Lonnie Cleek’s account of Thursday the 12th at Becky’s sister’s Rachel Crabtree’s

Volume 2 – p253

Q And did you — did you go to her home (Rachele Crabtree’s) to visit — talk about some photographs

A I did.

Q And when you went out there how was she feeling (Becky Hill)

A Not very well.

Q And were you — what were your intentions as far as photographs that day

A I wanted to show her a photo lineup that we had made up.

Q And when you learned that she was not feeling well why did you — why did you not go ahead and do that

A She was still under a great deal of pain. She was in the bed resting. I didn’t foresee any need to force that issue and I decided to come back at a later time when she felt better.

Page 30 – line 2.

Q Okay. Where did they bring you this array of photos

A To my sisters Rachel Crabtrees

Q And where does she live?

A She  lives in Coalmont, between Coalmont and Tracy.

Q Okay. Was she there when the photo.line-up was given to you

A Brent and Lonnie took me into the kitchen and talked to me at the table.

Q Okay. Who did you give the description to of the young man who was in your house

A Well I didn’t-. give it-. To nobody they showed me the line-up. Like I said I had went – I didn’t know anything for like four days.

Q So up until they gave you the line-up you had not given anybody a description of the young man who came in your house on January the 7th twice

A No.

2111 Q Okay. And after the line-up did you

2211 give them a description

2311 A You know once I seen the picture I

2411 knowed him.

Becky Hill at Trial — account of Thurs the 12th at her sister Rachel Crabree’s.

Volume 1 p55 line 4

Q You told us on February the 28th 2006 that you were at your sister’s house when the sheriff and Lonnie came out there.

A Yes I was.

Q They had 10 or 12 pictures

A I don’t know how many pictures they had. I went to the jail and looked at the pictures.

Q Okay. Now you told us on February the 28th 2006 that the sheriff and the deputy came to your sisters house.

A Yes.

Q Are you saying now that you went to the jail to look at these pictures

A Later on. I went to the jail later on

Q No but after you saw the pictures and all that.

A I went and picked him out of a line-up.

Q Okay. So after you saw the pictures they took you to the jail

A Not – not the same day.

Judge Easters take on the Thurs the 12th at Rachel Crabtee’s

“Chief Deputy Cleek testified at trial that the first time he went to talk with her (at Rachel Crabree’s on Thurs the 12th), Ms. Hill was in no position to either give a statement or look at pictures because she was unconscious.”

Unconscious! Un-real.

Where does it say Becky Hill was unconscious?

The whole purpose of this weaseling is to claim Becky Hill did not have the opportunity to make a mis-identification.

I think most people who read this can go much further and say Cleek showed Becky Adam.s pictures — and then only claimed she was sick because she refused to identify Adam —  because Becky Hill had never seen Adam Braseel before in her life. And certainly not at her house beating her.

Becky Hill knew exactly who beat her. But she was coerced into saying it was Adam under some threat like we have seen from Larry Davis in the internal TBI memo pertaining to Grimes– or the woman I interviewed —  who said Strain tried coercing her to accuse a man of stealing her car when she knew exactly the woman who stole her car.
